Conditions of the AbZOOlutely Auction
By placing an absentee bid or bidding at the live auction, the bidder indicates acceptance of the following condition:
- All animals are sold "as is." AbZOOlutely Chestnut Hill makes no representations nor warranties of any kind or nature concerning the accuracy of the catalogue or web site, nor concerning the animals, with respect to the actual creator of the artistic decoration, the fitness of the animal for any particular purpose, the importance or quality of the animal, nor of any other kind relating to the creation or nature of the animal.
- Prospective bidders should inspect the animals before bidding to determine their condition. These animals have been on public display since September, they have been moved a number of times, and some have had to be repaired. AbZOOlutely Chestnut Hill will make every effort to make our descriptions as accurate as possibly and bidders can contact the Zoo office or see the animals at the preview to better determine their condition.
- Any animal may be withdrawn by AbZOOlutely Chestnut Hill at any time before the actual sale without any liability thereof.
- Bidders must register before placing a bid; registration signifies acceptance of these conditions of auction. AbZOOlutely Chestnut Hill reserves the right to reject any registration or any bid from any bidder for any reason whatsoever.
- The highest bidder acknowledged by the auctioneer, either on the floor or by absentee bid, shall be deemed the purchaser of the animal. In the event of any dispute between bidders, or any other issue with respect to the bidding, the auctioneer shall have sole and final discretion either to determine the successful bidder or to offer and resell the animal in dispute. If any dispute arises after the sale, AbZOOlutely Chestnut Hill's sale records shall be conclusive.
- Bidders need not be present at the live auction to win. As a convenience, AbZOOlutely Chestnut Hill will execute absentee bids, but we are not responsible for failing to execute such bids nor for any error or omissions in connection therewith.
- A starting bid shall be determined by AbZOOlutely Chestnut Hill. The animals will be offered with a modest reserve, which is a confidential minimum price below which the animal shall not be sold. The auctioneer may implement this reserve by bidding up to the reserve on behalf of AbZOOlutely Chestnut Hill. If any animal fails to meet the reserve bid, AbZOOlutely Chestnut Hill will retain ownership and will attempt to sell the animal at the reserve price after the auction.
- There is no buyer's premium.
- The order of animals in the auction shall be determined by a random draw, except the first items which shall be auctioned at an open bid.
- On fall of the auctioneer's hammer, the highest bidder shall be deemed to have purchased the offered animal. The highest bidder will immediately assume the risk and responsibility of the animal and shall pay the full price thereof.
- The concrete base for each animal will be available to the purchaser. Delivery of the concrete base will be at the expense of the purchaser.
- The purchaser is responsible to pick up the animal within six days, though delivery can be arranged through AbZOOlutely Chestnut Hill at an extra charge. If the animal is not collected nor shipped within this time, the animal shall be put into storage, with the expense of shipment and storage added to the purchase price of the animal.
- If the foregoing conditions and other applicable conditions are not complied with, AbZOOlutely Chestnut Hill will have the right to cancel the sale and resell the animal on three days notice to the purchaser. In such event, the original purchaser shall be liable to payment of any expenses incurred in the storage and resale of the animal.
